Filing documents before the Justice of the Peace cannot take place by certified e-mail or by registered mail online to the Italian Postal Service servers

Civil Superior Court, Section II, 29 September 2020, Judgement no. 20575. Pres. Di Virgilio, Est. Varrone

date: 27.10.2020
Area: Litigation and Arbitration

According to the Italian Superior Court, with the ruling in question the filing of documents before the Justice of the Peace cannot take place by certified e-mail or by registered mail online to the servers of the Italian Post Office. The Superior Court comes to this conclusion on the assumption that, since it is only before the Justice of the Peace that the rules governing the telematic trial are not yet effective, it is necessary to extract paper copies of the digital documents and certify their conformity, by virtue of the power specifically conferred on defence counsel by Law no. 53 of 1994, art. 6 and art. 9, paragraphs 1 bis and 1 ter.
