In the ruling in question, the Court of Vicenza concluded that it was up to the expert to inform his/her client if he/she believes that an appeal against a tax measure may have little chance of success. In such cases, the expert will have the burden of dissuading the client from resorting to tax justice by directing him/her, towards forms of settlement concessions of the assessment. Clearly, in this case, the burden of demonstrating the correct information of the client will fall on the expert.
