As a rule, company leasing will result in the termination of the status of entrepreneur, unless the assessment ordered by the judge shows that the activity has actually continued

With the ruling under examination, the Italian Superior Court established that when the entrepreneur is declared bankrupt, the leasing of the company usually determines the termination of the entrepreneur’s status. However, the Superior Court held that the above rule finds an exception if there is a factual assessment by the Judge which can prove a compatibility between the leasing of the business and the continuation of the business which, however, must be effective.
