Commercial leases: rent reduction during lockdown

With the Order in question, the Court of Venice did not validate the eviction of the defaulting tenant for payment of the rent from December 2019 until May 2020: a) during the lockdown period, the tenant was unable to fully use the premises covered by the contract (in this case, intended for tourist accommodation) and the landlord’s services became partially impossible due to the restrictions imposed by the emergency regulations; b) for the purposes of the seriousness of the breach claimed by the landlord and, therefore, of the ruling on the request for termination of the commercial lease, the tenant’s right to request a reduction of the rent for the lockdown period must also be taken into account, pursuant to article 1464 of the Italian Civil Code.
