Covid-19 and suspension of protested bills/checks

Court of Lecce, 29 May 2020

date: 18.06.2020
Area: Corporate, M&A

With the ruling in question, the Court of Lecce concluded that, if the bank cheques were presented for payment between 31 March and 17 April 2020 and protested by the notary public after 30 April 2020, it is up to the delegated Judge to intervene with an urgent measure ordering their suspension or cancellation. In fact, according to the Court, the cancellation or suspension measure would be based on the assumption that it would be difficult and/or impossible to make payments for securities issued during the period of suspension of trading, with subsequent suppression of the constitutional rights of the individual.
